1) Scope
1.1 These General Terms and Conditions (GTC) of Eckhard Singer (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller via the online shop www.primo-odysee.de .
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.
1.3 An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.
2) Conclusion of contract
2.1 The products presented in the online shop do not constitute a legally binding offer, but rather an invitation to the customer to place an order.
2.2 The customer can submit a binding purchase offer via the online order form integrated in the online shop. After entering their personal data and clicking the button that completes the ordering process, the customer submits a legally binding offer.
2.3 The Seller may accept the Customer’s offer within five days by sending an order confirmation, delivering the ordered goods or requesting payment from the Customer.
2.4 The contract text will be saved by the seller and sent to the customer by email after the contract has been concluded.
2.5 The contract language is German.
3) Right of withdrawal
3.1 Consumers have a statutory right of withdrawal.
3.2 Further information on the right of withdrawal is set out in the Seller’s cancellation policy.
3.3 If the customer exercises their right of withdrawal, they shall bear the direct costs of returning the goods. We charge a flat rate of €6 per return shipment, which will be deducted from the refund amount.
3.4 The right of withdrawal does not apply to customers residing outside the European Union.
4) Prices and payment terms
4.1 All prices listed in the online shop are final prices including statutory VAT. Shipping costs are not included.
4.2 Additional costs (e.g. customs duties, taxes) for deliveries outside the EU are to be borne by the customer.
4.3 The customer may use the payment methods listed in the online shop, in particular Klarna, PayPal, Visa, Mastercard and Shopify Payments (Stripe).
5) Delivery and shipping conditions
5.1 Delivery will be made to the address provided by the customer.
5.2 If delivery cannot be made for reasons for which the customer is responsible, the customer shall bear the additional costs incurred.
5.3 The risk of accidental loss of the goods shall pass to the customer upon delivery.
5.4 Self-collection is not possible for logistical reasons.
6) Retention of title
The delivered goods remain the property of the seller until full payment has been made.
7) Liability for defects (warranty)
7.1 The statutory provisions on liability for defects apply.
7.2 For entrepreneurs, the warranty period is limited to one year.
7.3 Entrepreneurs must immediately report obvious defects.
8) Liability
8.1 The Seller shall be liable without limitation in the event of intent and gross negligence as well as in the event of injury to life, body or health.
8.2 In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for the contract.
8.3 Any further liability is excluded.
9) Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this applies only to the extent that it does not deprive them of mandatory consumer protection provisions of the country in which the consumer is resident.
10) Alternative dispute resolution
10.1 The EU Commission provides a platform for online dispute resolution (ODR platform): https://ec.europa.eu/consumers/odr
10.2 The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
